Accident At Work Compensation Claim

By Shannon L Smith

Accidents do happen and they can range from minor to major accidents. If you happen to be involved in an accident, you may not sustain an injury or you may be seriously injured. If you are injured in an accident which occurred due to no fault of yours, you are entitled to claim accident compensation. The first thing that you need to do is record all the evidence of the accident. Note down names and contact numbers of the people who witnessed the accident. An accident incurs costs and these costs can range from medical costs to loss of income. The expense that you may have to bear due to an accident depends on the extent of injury received by you. At times severe injuries can result which may cause permanent disability.

In quite a few cases the party at fault will compensate the injured party as nobody likes to get hauled up in a court case. The need to hire a lawyer to fight an accident compensation claim occurs when the party at fault refuses to pay the compensation or disagrees to the amount claimed or if more than one party is responsible for the accident. Since most people are insured it's the insurance company that has to pay the claim. Insurance company lawyers try to pay out the minimum compensation, as that's their job. They will try their utmost to minimize the losses claimed or will even dispute some of them.

Similarly, you should also claim your compensation within one year of the accident. This is important as the claim can get time barred.

There are different types of accidents that include both at work place and road accidents. However, for accident compensation claims you need to have all the bills including medical and ambulance bills. Similarly, you can also record the statements of witnesses to build a strong base for your accident compensation claims. Accident compensation claims can also be made for accidents at public places. You can claim compensation for accidents in the form of travelling expenses, loss of income expenses, medical care and assistance expenses. For this you need to have solid evidence. For claiming compensation for accident at your work place, you can also provide your lawyer the evidence or document of previous accidents. While claiming compensation for accidents you must have prove of the accident and of the expenses borne due to it.

You can also claim compensation for an accident at home, if the accident was caused due to a faulty appliance or any public utility. However in these cases you must be sure that the accident was not caused because of you or any of your family members. Filing and receiving accident compensation can either happen very fast or it can become a long drawn out process. The time it takes to settle an accident claim will depend on the stance that the accused party takes.

  1. In claiming for a work accident compensation, the claimant must provide a strong evidence that his or her injury was acquired after an accident which is caused by someone else negligence.
